In an originating summons, marked FHC/ABJ/CS/221/2025, filed at the Federal High Court in Abuja, Ewhrudjakpo alleged that some lawmakers were being pressured to initiate impeachment proceedings against him for remaining in the PDP after Governor Douye Diri resigned his membership of the party.
Through his counsel, Reuben Egwuaba, the deputy governor claimed that local government chairmen, including Mrs Alice Tange of Sagbama Local Government Area, were also being threatened with dismissal for their refusal to leave the PDP.
After hearing the ex parte motion on October 27, Justice Emeka Nwite ordered the defendants to appear before the court to show cause why interim reliefs sought by Ewhrudjakpo should not be granted.
Listed as defendants in the suit are the Bayelsa State House of Assembly, its Speaker, the Inspector General of Police (IGP), the Director General of the Department of State Services (DSS), the Attorney General of Bayelsa State, the Chief Judge, and the Clerk of the House.
Justice Nwite held that “the interest of justice will be met by directing the defendants to appear and show cause” and adjourned the case to 13 November.
Ewhrudjakpo is seeking several interim injunctions restraining the defendants from initiating or pursuing any impeachment action against him for refusing to defect to the All Progressives Congress (APC) before the expiration of his four-year tenure.
He is also asking the court to bar the police, DSS, and the state’s attorney general from withdrawing his security protection or recognising any APC nominee as deputy governor pending the determination of his substantive motion.
