Chinda Defection Records Demand Triggers Legal Battle

Kingsley Chinda defection records dispute intensifies as group seeks House of Reps evidence over alleged APC switch and minority leader resignation

Speaker of the House of Representatives, Tajudeen Abbas, has been formally requested to produce official parliamentary records amid a growing legal dispute over the alleged defection of lawmaker Kingsley Chinda and claims surrounding his resignation as Minority Leader of the House.

Kingsley Chinda defection records dispute escalated after the Incorporated Trustees of the Association of Legislative Drafting and Advocacy Practitioners filed a lawsuit at the Federal High Court in Abuja, seeking to prevent the Independent National Electoral Commission from recognising Chinda as a governorship candidate of the All Progressives Congress.

The group is asking the court to determine whether proper constitutional procedures were followed, particularly whether a formal letter of resignation and defection was read on the floor of the House during plenary sessions, as required under Section 68(1)(g) of the 1999 Constitution.

In a detailed Freedom of Information request dated 26 May 2027, the organisation demanded access to the Hansard, Votes and Proceedings, and Order Papers for House sittings in March and April 2026, describing the documents as critical evidence in establishing whether due process was observed.

The plaintiff argues that the validity of Chinda’s political transition hinges on whether the Speaker or any presiding officer formally communicated the resignation on the floor of the chamber, a procedural step they insist is essential under constitutional law.

The letter, signed by the association’s Administrative Secretary, Jesse Williams Amuga, was also copied to the Deputy Speaker and the Clerk of the House of Representatives, intensifying institutional scrutiny of the matter.

Chinda, an ally of FCT Minister Nyesom Wike, secured the APC governorship ticket in the May 2026 primary election following withdrawals by other aspirants, including Governor Siminalayi Fubara.

Meanwhile, the Centre for Constitutional Governance and Electoral Integrity has argued that Chinda had already stepped down as Minority Leader before engaging in the APC primary process, insisting that he had effectively disengaged from PDP activities prior to his candidacy.

The unfolding dispute is expected to test constitutional interpretations of legislative defection procedures and the evidentiary role of parliamentary records in electoral disputes.
