PDP Seeks Lawmakers’ Removal over Defection to APC

PDP seeks lawmakers’ removal in court, urging the sack of four Osun legislators who defected to APC, citing Section 68(1)(g) of the Constitution

PDP seeks lawmakers’ removal in a fresh legal move at the Federal High Court, Abuja, where the opposition party is demanding the sack of four Osun lawmakers who defected to the All Progressives Congress (APC).

The affected legislators are Senator Francis Adenigba Fadahunsi (Osun East), Senator Olubiyi Oluwole Fadeyi (Osun Central), Hon. Omirin Emmanuel Olusanya (Atakumosa East/West and Ilesa East/West Federal Constituency), and Hon. Taofeek Abimbola Ajilesoro (Ife Federal Constituency).

In four separate suits filed on Wednesday by lead counsel Raphael Oyewole, the PDP listed each lawmaker as the 1st defendant.

The Senate President, the Speaker of the House of Representatives, the National Assembly, its Clerk, and the Independent National Electoral Commission (INEC) were also joined as defendants.

The PDP argued that, under Section 68(1)(g) of the 1999 Constitution (as amended), any lawmaker who defects from the party that sponsored them without evidence of a division, merger, or faction automatically forfeits their seat.

The party urged the court to declare the seats vacant and compel Senate President Godswill Akpabio and House Speaker Tajudeen Abbas to act accordingly.

It also asked for orders stopping salaries and allowances for the defectors, directing INEC to conduct bye-elections, and refunding all benefits collected since their defection.

The cases, filed under suit numbers FHC/ABJ/CS/1725/2025, FHC/ABJ/CS/1728/2025, FHC/ABJ/CS/1727/2025, and FHC/ABJ/CS/1726/2025, target Fadahunsi, Fadeyi, Olusanya, and Ajilesoro respectively.

For the PDP, enforcing these reliefs will strengthen constitutional order and prevent what it calls a “violation of democratic mandate.”
