Nigel Farage, former leader of the Brexit Party, is facing scrutiny over claims that his 2024 election campaign in Clacton exceeded the legal spending limit of £20,660.72.

Documents detailing the alleged overspend were submitted to the police by Richard Everett, a former Reform councillor who has since left the party.

The Reform Party campaign in Clacton has raised questions over the distinction between candidate and party spending, a legal complexity rooted in the Corrupt and Illegal Practices (Prevention) Act of 1883 and subsequent electoral reforms.

Candidate spending applies to individual campaigns, while party spending is for broader messaging.

Misreporting between the two categories has historically triggered investigations, most notably in the 2015 Conservative “battle bus” case.

In this instance, experts note several factors that may limit the impact on Farage.

The alleged overspend occurred more than a year ago, surpassing the usual statute of limitations for reporting suspected electoral offences.

Moreover, candidate spending offences are investigated by the police, who tend to be reluctant to intervene in politically sensitive matters, while the Crown Prosecution Service must prove both the overspend and that Farage knowingly made a false declaration under Section 82(6) of the Representation of the People Act 1983.

As the face of Reform in Clacton, Farage’s dual role as party leader and candidate further complicates the legal distinction.

Analysts suggest that minor overspending would likely be considered not in the public interest to prosecute, and any charges may fall on campaign administrators rather than Farage personally.
