Federal Court Dismisses Anyanwu’s PDP Secretary Suit

Federal High Court in Abuja dismisses Anyanwu’s PDP Secretary suit, citing expired tenure, with no cost awarded to any party

The Federal High Court in Abuja on Tuesday dismissed a suit filed by Senator Samuel Anyanwu, a factional National Secretary of the Peoples Democratic Party, PDP, seeking official recognition as the party’s scribe.

Justice Mohammed Umar struck out the case after it was established that Anyanwu’s tenure as PDP National Secretary expired in December 2025, rendering the matter academic.

The suit, marked FHC/ABJ/CS/254/2025, had been filed against the Independent National Electoral Commission, INEC, and former Acting PDP National Chairman Umar Damagun, with additional defendants including the PDP and Sunday Udeh-Okoye.

Anyanwu, through his counsel U.C. Njemanze-Aku, informed the court that developments had overtaken the suit and requested its withdrawal.

Counsels for the defendants urged the court to dismiss the matter with costs, but Justice Umar ruled otherwise.

“Since you have joined issues, I am going to dismiss this matter. The matter is hereby dismissed,” he stated, adding that no cost would be awarded as the delay was not attributable to any party.

The dispute over the PDP National Secretary position dates back to Anyanwu’s vacating of office to contest the 2023 Imo State governorship election, which he lost. Rival claims, including Sunday Udeh-Okoye’s, escalated into multiple court actions, including a Supreme Court reinstatement of Anyanwu in March 2025.

Despite the apex court ruling, leadership tensions continued, prompting Anyanwu to institute the fresh suit in Abuja.

Tuesday’s dismissal effectively closes this latest chapter in the long-running PDP leadership dispute.
